Terms of Service

These terms are an agreement between you and Launching Ideas INC, a California corporation doing business as FileTrove (“FileTrove,” “we,” “us”), covering your use of filetrove.app, our browser extension, and our API (together, the “Service”). By creating an account or using the Service you agree to these terms and to our Privacy Policy.

1. The Service

FileTrove lets you store files and organize them into shareable collections called troves. Troves are private by default; you choose per trove whether to share it by link, protect it with an access code, or publish it to the public gallery. Publishing to the gallery may be subject to review before the trove is listed in the directory or search.

2. Your account and handle

• You must be at least 13 years old (or older where your local law requires) to use the Service, and at least 18 to purchase a paid plan.
• You are responsible for your password, for enabling any security features you need (such as two-factor authentication), and for all activity on your account.
• Your handle is your permanent public name on the Service. Handles cannot be changed once set, may not impersonate others or squat on trademarks, and we may reclaim handles that violate these rules.

3. Plans, billing, and refunds

• Paid plans are billed annually through Stripe and renew automatically until cancelled. You can cancel any time; your plan then runs to the end of the paid term and does not renew. Except where the law requires otherwise, payments are non-refundable.
• If a paid plan lapses, your content is not deleted, but plan limits (such as storage caps) again apply, and we may restrict uploads until usage is within your tier’s limits.
• We may change prices or plan features prospectively; existing paid terms are honored, and we will give notice before a renewal at a changed price.

4. Your content

• You own your files. We claim no ownership of anything you upload.
• You grant us the limited license needed to operate the Service: to store, copy, resize, transmit, and display your content (for example, generating thumbnails, streaming files to people you share with, and showing public troves in the gallery), consistent with the sharing settings you choose.
• Optional AI features (caption suggestions, tags) send file content to our AI provider for processing, as described in the Privacy Policy. Uploaded content is also screened for prohibited material.
• You are responsible for having the rights to everything you upload and share.

5. Acceptable use

You may not use the Service to store or share content that is illegal, that sexually exploits minors, that infringes others’ intellectual property or privacy, or that contains malware; to harass or defraud others; to send spam; or to probe, overload, or circumvent the security or fair-use limits of the Service. We may remove content, unlist troves from the gallery, throttle, suspend, or terminate accounts that violate these rules, and we cooperate with lawful requests from authorities.

6. Copyright and DMCA

We respond to copyright takedown notices as described in our DMCA Policy, and we terminate the accounts of repeat infringers. If you believe content on FileTrove infringes your copyright, please use the process on that page.

7. Storage, expiry, and backups

• Troves can have expiration dates; an expired trove returns to private and, under your plan’s rules, content may eventually be queued for deletion. Deleted content is removed through a trash process and is not recoverable once purged.
• The Service is a sharing tool, not a backup service. Keep your own copies of anything you cannot afford to lose.

8. Termination

You may stop using the Service or ask us to close your account at any time by contacting support@filetrove.app. We may suspend or terminate accounts that violate these terms, create risk for the Service or others, or remain unpaid where payment is required. After account closure, we delete your content on a reasonable schedule.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL NEVER BE LOST.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FILETROVE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You will defend and hold FileTrove harmless from claims arising out of your content, your use of the Service, or your violation of these terms or of others’ rights.

12. Disputes

These terms are governed by California law. Before filing any claim, you agree to contact us at support@filetrove.app and give us 30 days to work it out informally. Either party may bring qualifying claims in small-claims court. Otherwise, disputes will be resolved by binding individual arbitration in Alameda County, California, and both parties waive class actions and jury trials. You may opt out of arbitration by emailing us within 30 days of first accepting these terms.

13. Changes to these terms

We may update these terms as the Service evolves. For material changes we will give notice (by email or on the site) before the new terms take effect; continuing to use the Service after that means you accept them.
